Mediation Results

When parties eventually agree through mediation, this is usually documented in a contract of settlement, drafted by the Mediator.

A contract of settlement is a contract in which two or more parties submit to a binding arrangement in order to solve an existing dispute, or to avoid one in the future.

There are several ways to draft a contract of settlement:

  • Parties can document that they are independently capable of solving their dispute together.
  • Parties can document a number of agreements outlining their plan of finding a way to solve the dispute together.
  • Parties can document the exact way the dispute has been fully solved and which precise agreements have been made as a result of that.
  • Parties can document the exact way the dispute has been partially solved, which precise agreements have been made as a result, and if desired, the steps to solving the remaining dispute (together, through a binding ruling, arbitration, adjudication).

For the latter two ways and if so desired by the parties involved, we can provide an enforcement order for all that is documented in the contract of settlement, so long as it is measureable, enforceable and time-related.

We can also provide an enforceable solution through binding ruling in case of (remaining) disputes.
